Every landlord will at some point in time face the problem of a non-paying tenant. If the matter is not dealt with urgently the landlord’s damages will grow on a monthly basis due to the lack of rental income.Evictions of non-paying tenants from houses; flats; dwellings (not commercial property)are in most instances regulated by the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act (the PIE Act).


In terms of the PIE Act no person may be evicted from their home without an order of a competent Court.The Court will only grant an eviction order if the Court is of the opinion that it is just and equitable to do so after considering all relevant circumstances. It is therefore important to comply with all the requirements of the Pie Act and to place all relevant circumstances before the Court when bringing an application for eviction.


Many landlords take matters into their own hands by simply changing the door locks or by placing other people in the property to live with the non-paying tenants. These illegal methods can make the situation worst for the landlord as the non-paying tenants can hold the landlord responsible for any damages they might suffer due to the landlord not following the correct and legal procedure.
